ServicePilot AI uses artificial intelligence technology to answer phone calls, qualify leads, and book appointments on behalf of your business. AI technology, while powerful, has inherent limitations. By using our services, you acknowledge and accept the following.

ServicePilot AI does not guarantee any specific business outcomes, including but not limited to increased revenue, lead conversion rates, appointment bookings, or customer satisfaction. Not a Substitute for Professional Services

ServicePilot AI is a call handling and lead qualification tool. It is not a substitute for licensed professionals, including but not limited to attorneys, medical professionals, financial advisors, or emergency services. The AI does not provide legal, medical, financial, or emergency advice. Any information provided by the AI should not be relied upon as professional guidance.

Emergency Calls

While our AI includes emergency triage capabilities, it is not a replacement for 911 or emergency services. If a caller reports an emergency, the AI will attempt to direct them to appropriate emergency services, but we cannot guarantee this will happen correctly in every situation. You should always have procedures in place for handling emergencies that do not rely solely on AI.

Service Availability

We strive for maximum uptime but do not guarantee uninterrupted service. Our AI receptionist may experience downtime due to maintenance, technical issues, third-party service disruptions, or other factors beyond our control. ServicePilot AI is not liable for any losses incurred during periods of service unavailability.

Indemnification

You agree to indemnify and hold harmless ServicePilot AI, its owners, employees, and affiliates from any claims, losses, damages, liabilities, or expenses (including attorney fees) arising from your use of our services, your violation of this disclaimer, or any third-party claims related to information provided by the AI on behalf of your business.

Disclaimer of Warranties

OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that our AI will operate error-free, uninterrupted, or free from harmful components. We do not warrant that AI-generated responses will be accurate, complete, current, or suitable for your specific business needs. No advice or information, whether oral or written, obtained from ServicePilot AI or through our services shall create any warranty not expressly stated herein.

Maximum Liability Cap

IN NO EVENT SHALL SERVICEPILOT AI'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO OUR SERVICES EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO SERVICEPILOT AI IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THIS LIMITATION APPLIES REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE.

Assumption of Risk

You expressly acknowledge and agree that the use of AI technology for business communications involves inherent risks. By using ServicePilot AI, you voluntarily assume all risks associated with AI-powered call handling, including the risk that the AI may provide incorrect, incomplete, or inappropriate responses to your callers. You agree that you have made your own independent assessment of the risks involved and have chosen to proceed with full knowledge of these risks.

Third-Party Services

ServicePilot AI integrates with third-party telephony providers, AI platforms, and other services. We are not responsible for the performance, availability, accuracy, or policies of any third-party services. Any issues arising from third-party service failures, outages, or errors are not the responsibility of ServicePilot AI. Your use of third-party services is subject to their respective terms and conditions.

Governing Law and Jurisdiction

This disclaimer and any disputes arising from your use of our services shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Spokane County, Washington for the resolution of any disputes.

Dispute Resolution and Arbitration

Any dispute, controversy, or claim arising out of or relating to this disclaimer or our services shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may submit the dispute to binding arbitration administered in Spokane, Washington in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding. Judgment on the award may be entered in any court of competent jurisdiction.

Class Action Waiver

YOU AGREE THAT ANY CLAIMS AGAINST SERVICEPILOT AI WILL BE BROUGHT SOLELY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration against ServicePilot AI.

Force Majeure

ServicePilot AI shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of God, pandemics, government actions, power outages, internet or telecommunications failures, cyberattacks, third-party service disruptions, or any other force majeure event.

Severability

If any provision of this disclaimer is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remainder of this disclaimer shall remain in full force and effect.

Entire Agreement

This disclaimer, together with our Privacy Policy and any service agreement you have entered into with ServicePilot AI, constitutes the entire agreement between you and ServicePilot AI regarding the subject matter herein and supersedes all prior or contemporaneous understandings, agreements, or communications.

Changes to This Disclaimer

We reserve the right to update this disclaimer at any time without prior notice. Changes become effective immediately upon posting. Your continued use of our services after any changes are posted constitutes your binding acceptance of the revised terms. It is your responsibility to review this disclaimer periodically.
